DMCA Notice and Takedown Policy

1. Purpose

This Digital Millennium Copyright Act (“DMCA”) Notice and Takedown Policy outlines the procedures that copyright owners (“Complainants”) and users of HimalayanInstitutes.com (the “Website”) must follow regarding allegations of copyright infringement. We respect the intellectual property rights of others and are committed to complying with the DMCA.

2. Reporting Copyright Infringement

  • A statement that the Complainant has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the Complainant is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • A physical or electronic signature of the Complainant or a person authorized to act on their behalf.

Please note: If you knowingly misrepresent that material is infringing, you may be subject to liability for damages, including costs and attorneys’ fees, under Section 512(f) of the DMCA.

4. Procedure for Handling Infringing Material

Upon receipt of a valid DMCA notice, we will follow these procedures:

  • We will promptly remove or disable access to the allegedly infringing material.
  • We will take reasonable steps to notify the user who posted the allegedly infringing material (“Alleged Infringer”) that their material has been removed or disabled.
  • We may provide the Alleged Infringer with a copy of the Complainant’s notice and the Complainant’s contact information.

5. Counter-Notification Procedure

If you, as an Alleged Infringer, believe that the material that was removed or to which access was disabled is not infringing, or that you have the right to post and use such material from the copyright owner, the copyright owner’s agent, or pursuant to the law, you may send a counter-notification to our Designated Copyright Agent. To be effective, your counter-notification must include substantially the following information:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled: Please provide the specific URLs or other identifying information.
  • Your name, address, telephone number, and email address.
  • A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the Complainant or an agent of such person.
  • Your physical or electronic signature.

6. Procedure Following Counter-Notification

Upon receipt of a valid counter-notification, we may:

  • Provide the Complainant with a copy of the counter-notification and inform them that we may reinstate the removed material or cease disabling access to it in ten (10) to fourteen (14) business days.
  • Reinstate the removed material or cease disabling access to it, in our sole discretion, not less than ten (10), nor more than fourteen (14), business days following receipt of the counter-notification, unless our Designated Copyright Agent has first received notice from the Complainant that such Complainant has filed an action seeking a court order to restrain the Alleged Infringer from engaging in the infringing activity relating to the material on our Website.

7. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.

8. Changes to This DMCA Policy

We reserve the right to modify this DMCA Notice and Takedown Policy at any time without prior notice. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website after the posting of revised Policy constitutes your acceptance of the changes. It is your responsibility to review this Policy periodically.
